Terms of Service

1. Acceptance of Terms

By accessing or using RottoWatch ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

2. Description of Service

RottoWatch is an accommodation availability monitoring service for Rottnest Island. We periodically check the StayRottnest booking website for availability matching your specified criteria and notify you via email when a match is found.

RottoWatch does not book accommodation on your behalf. When availability is found, you are responsible for completing the booking directly through the official StayRottnest website.

3. Accounts

You must create an account to use RottoWatch. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to:

• Provide accurate and complete information when creating your account
• Keep your password secure and not share it with others
• Notify us immediately of any unauthorised access to your account
• Not create multiple accounts to circumvent free tier limits

4. Free and Paid Plans

Free Plan

• 1 active watch at a time
• Daily availability check
• One-time email notification per watch
• Up to ±3 days date flexibility

Watcher Plan ($5 AUD/month)

• Unlimited active watches
• Availability checks every 4 hours
• Daily email updates when availability exists
• Up to ±7 days date flexibility

We reserve the right to modify plan features and pricing with reasonable notice. Existing subscribers will be notified of any changes before they take effect.

5. Billing and Payments

Paid subscriptions are billed monthly through Stripe. By subscribing, you authorise us to charge your payment method on a recurring basis until you cancel.

• Subscriptions renew automatically at the end of each billing period
• You may cancel your subscription at any time through the billing page — your access continues until the end of the current billing period
• Refunds are handled on a case-by-case basis — contact us at support@rottowatch.com.au
• All prices are in Australian Dollars (AUD) and include GST where applicable

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Attempt to access, tamper with, or use non-public areas of the Service
• Use the Service to send spam, unsolicited communications, or misleading content
• Reverse engineer, decompile, or disassemble any part of the Service
• Create automated systems (bots, scrapers) that access the Service beyond normal use
• Resell, sublicence, or redistribute access to the Service without our written consent

7. No Guarantee of Availability

RottoWatch does not guarantee that accommodation will be available. We provide a monitoring and notification service only. Availability on Rottnest Island is subject to the policies and inventory of the Rottnest Island Authority and StayRottnest.

We also cannot guarantee that our checks will detect every availability change. The StayRottnest website may experience downtime, change its structure, or otherwise become temporarily unavailable, which may affect our ability to check availability.

8. No Affiliation

RottoWatch is an independent service and is not affiliated with, endorsed by, or associated with the Rottnest Island Authority, StayRottnest, or any government body. "Rottnest Island" and "StayRottnest" are trademarks of their respective owners.

9. Intellectual Property

The Service and its original content, features, and functionality are owned by RottoWatch and are protected by applicable copyright, trademark, and other intellectual property laws.

10. Limitation of Liability

To the maximum extent permitted by Australian law, RottoWatch and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, or anticipated savings
• Loss of data or goodwill
• Missed bookings or accommodation opportunities
• Service interruptions or downtime

Our total liability for any claim arising from your use of the Service shall not exceed the amount you have paid us in the 12 months preceding the claim.

11. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. You may delete your account at any time.

Upon termination, your right to use the Service will cease immediately. Sections of these Terms that by their nature should survive termination shall survive (including limitation of liability, disclaimers, and governing law).

13. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the revised Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Western Australia, Australia, without regard to conflict of law principles. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Western Australia.
